CIL EXPENDITURE FRAMEWORK: EIGHTH REVIEW
The amendments approved by Babergh on 22 September, and before Mid Suffolk this evening, raise the officer delegation threshold for CIL awards from £30,000 to £50,000, with decisions referred to Cabinet for noting, and move that authority from the Director of Place to the Head of Strategic Planning. They add nature recovery schemes (bids over £30,000 capped at £100,000, with 25% from other funding sources; schemes under £30,000 funded from unallocated Neighbourhood CIL only), sustainable travel hubs and bus station improvements (no 100% District CIL schemes; financial ceiling £100,000 for travel hubs), and allow strategic infrastructure projects three years rather than two to complete where justified. Flooding measures continue to sit outside the framework.

AUDIT: FIVE YEARS OF DISCLAIMED OPINIONS, AND THE PLAN TO REBUILD ASSURANCE
A report to the Joint Audit and Standards Committee on 28 September 2026 presents the external auditor EY's "Rebuilding Audit Assurance — The Path to an Unqualified Opinion" reports for both councils. It records that disclaimed audit opinions were issued for both councils for the period 2020/21 to 2024/25, under the National Audit Office's Local Authority Reset and Recovery arrangements, and sets out management's response and progress on a Finance Action Plan. The report states that a disclaimer "should not automatically be interpreted as evidence that balances are materially incorrect", and that EY's report is a forward-looking assessment of audit risk rather than evidence of known material misstatement. The committee is asked to note the reports.

THE COUNTDOWN
The Government withdrew its March 2026 decision to replace Suffolk's six councils with three unitary councils on 7 September 2026, pending a review. The councils' joint Local Government Reorganisation page now states that the Government has confirmed that district and borough council elections in Suffolk will take place in May 2027 on existing council boundaries, and that the planned shadow unitary council elections will not go ahead. It states that plans for devolution, including the election of a mayor for Suffolk and Norfolk in 2028, are continuing. The Government's announcement confirms that local elections in May 2027 will go ahead on existing council boundaries.
The Vesting Day set by the withdrawn decision, 1 April 2028, is 555 days away; that date is suspended while the review takes place, and no revised timetable has been published.
This week: the councils' Forthcoming Decisions List no longer lists the "Funding Suffolk Local Government Reorganisation (LGR) Transition Budget" item previously due on 22 October 2026 (see In the Chamber).

HOW IT WORKS
WHAT IS A DISCLAIMED AUDIT OPINION?
Every year an external auditor gives an opinion on a council's statement of accounts. A disclaimed opinion means the auditor has not been able to obtain enough evidence to give an opinion at all. The councils' report to the Joint Audit and Standards Committee explains that, under the National Audit Office's Local Authority Reset and Recovery arrangements, disclaimers were issued for 2020/21 to 2024/25, and that a disclaimer "should not automatically be interpreted as evidence that balances are materially incorrect". Assurance is then rebuilt over later years' audits, moving towards a modified and ultimately an unqualified ("clean") opinion.
