IN THE CHAMBER
COLCHESTER GOVERNANCE AND AUDIT COMMITTEE TAKES QUARTER ONE FINANCE, TREASURY AND AUDIT PAPERS (Committee — six reports)
The Governance and Audit Committee met on 8 September and considered six reports.
The Q1 finance monitoring report records a forecast net deficit of around £2.4m on General Fund revenue for 2026/27. At service level the report records an overspend of around £3.8m, partially offset by a business rates pooling benefit of around £1.4m on corporate income and expenditure. General Fund capital is forecast at around £40.3m against a budget of around £41.0m, an adverse position of around £0.7m. The Housing Revenue Account is forecast at a deficit of around £0.4m, a favourable position of around £0.2m against a budgeted deficit of around £0.6m. The committee was asked to note the revenue, capital and Housing Revenue Account positions.
The treasury management update covers 1 April to 30 June 2026. It records that the council repaid a £5m General Fund short-term loan from another local authority during the quarter, reducing borrowing from the 2025/26 outturn position of £212.9m to £207.9m, and that no new external borrowing was undertaken, with internal borrowing maximised. Of the £207.9m, around £189.4m is via the Public Works Loan Board, with £8m in short-term loans from other local authorities and £10.5m from banks. The report forecasts a year-end borrowing balance of £264.9m, an increase of £57m on the Q1 position, with £58m to be refinanced and £55m of new borrowing during the remainder of the year — £26.4m Housing Revenue Account and £16.4m General Fund. Investments stood at around £35.3m, an increase of £13.1m on the 2025/26 outturn, and investment income for the quarter was £0.170m against a budget of £0.425m. On prudential indicators, the report records that the 2025/26 annual review reported a 4% breach of the maturity structure indicator, that limits are not absolute and a breach prompts a review of risk exposure rather than constituting a compliance failure, and that officers are reviewing the profile with revised limits to come to the committee ahead of Full Council approval. Compliance with the authorised limit for external debt and the operational boundary for external debt is confirmed.
The audit tracker update covers implementation of recommendations arising from the 2024/25 final accounts process raised by external auditors KPMG, whose review of internal controls and governance structures produced two reports covering the Value for Money and ISA 260 assessments. The tracker is shared with the committee and the Senior Leadership Board quarterly. The report records that the tracker will enhance preparedness for local government reorganisation by improving control and governance structures.
The committee also considered the social housing landlord performance report for Quarter 1, covering compliance and delivery against the Regulator of Social Housing's Consumer and Rent Standards, accompanied by a highlight report, medium term delivery plan targets, quarterly Ombudsman determinations and the committee work plan; the Ombudsman annual review letter reported separately below; and its work programme for the municipal year.
Under Item 10 the committee resolved to exclude the public under Section 100A(4) of the Local Government Act 1972 to consider a confidential appendix to the finance monitoring report. That appendix is not for publication by virtue of paragraph 3 of Part 1 of Schedule 12A to the Act, covering the financial or business affairs of a particular person including the authority holding the information.

OMBUDSMAN ANNUAL LETTER SETS OUT FIGURES FOR ALL THREE DISTRICTS (Committee report — annual review)
The Local Government and Social Care Ombudsman's annual review letter for the period ending 31 March 2026 was reported to Colchester's Governance and Audit Committee on 8 September, having been reported to Cabinet on 21 July 2026.
The report records that three complaints were investigated and two upheld, both relating to housing, that neither upheld complaint carried a finding of maladministration and that no reports were issued. Compliance with the Ombudsman's recommendations is recorded at 100%. The council received 26 complaints and enquiries in 2025/26, against 28 in 2024/25 and 22 in 2023/24. By category the 2025/26 figures are: housing 10, environmental services, public protection and regulation 6, highways and transport 3, planning and development 3, benefits and tax 2, corporate and other services 2. Of the decisions made, nine were closed after initial enquiries, eight referred back for local resolution, one not upheld and two upheld, giving an uphold rate of 67%. Adjusted for population, the report records one upheld decision per 100,000 residents, the same as the average for authorities of this type and unchanged from 2024-25.
On the first upheld case the report records that the Ombudsman found fault causing injustice in the provision of suitable accommodation, in a complaint concerning a household following a Section 21 notice and eviction, interim accommodation said to be unsuitable, and an offer of accommodation made and then withdrawn. The recommended remedy was a written apology, a financial payment and service improvements. On the second the report records that the council delayed acting on reports of serious disrepair and hazards in a privately rented home, delayed inspecting and carrying out a Housing Health and Safety Rating System assessment, and failed to take formal enforcement action when it found a category 1 hazard; the council agreed to apologise, make a symbolic payment and provide training and guidance to relevant officers.

TENDRING ADOPTS FIVE STRATEGIES AND SEVEN HOUSING POLICIES (Delegated decisions — policy)
Five strategies were adopted on 8 September, each published alongside a consultation draft: the Climate Action Strategy and Action Plan refresh, and strategies for public arts, creative and cultural services, tourism, and community development.
A cluster of seven housing policies was published on 7 September: tenant involvement; neighbourhood management for housing; housing anti-social behaviour and hate incidents; position statements for the Regulator of Social Housing; the Housing Improvement Programme allocation for 2026/27; initiation of the use of Disabled Facilities Grant monies; and a property dealing policy for the acquisition of properties to augment council housing stock.
Minutes of the Council meeting of 1 September were published on 4 September, and minutes of the Planning Policy and Local Plan Committee of 25 August were published on 3 September.

COLCHESTER LGR PANEL TAKES PROGRESS AND ASSET DISPOSAL UPDATES (Committee — three reports)
The LGR Transformation and Transition Panel was due to meet on 9 September to consider an LGR progress and risk update, an update on the asset disposal programme, and its work programme for the municipal year. The committee record still showed the meeting as scheduled rather than occurred when checked, and minutes have not been published, so no account is given here of what the panel resolved.
The progress report was published with the agenda and is reported in The Countdown below. The asset disposal update records that the council adopted a new Estate Plan at Cabinet in March 2024, establishing the policy framework and strategic principles for proactive management of the estate, and that work since adoption has covered three priority areas: assessing liabilities within the corporate and operational portfolio, reviewing performance and opportunities within the investment portfolio, and revising management of the voluntary and community sector portfolio. The report records that Cabinet approved the business case for the asset disposals programme on 28 January 2026, that an update was provided to the panel on 15 July 2026, and that a further update is contained in a Part B report. It is for noting only.

Braintree's meetings and decision planner were not reached this issue, so no Braintree committee business is reported. The district's separate delegated decisions register has returned no content on repeated correctly-bounded searches and is treated as unavailable rather than empty.
PLANNING WATCH
This section covers planning applications validated and decided in the two most recent complete portal weeks, 24 August to 6 September 2026. The week of 24 to 30 August was reported in our last issue and is not repeated here; everything below is from 31 August to 6 September 2026, except where an earlier application reached a decision in that week. Planning therefore runs a few days behind the rest of the briefing, because the councils' own planning registers publish by whole weeks.
Comments on an application are normally accepted for 21 days from the date it is publicised. Each district's full register of applications appears below its round-up, and every reference links to that application's own page on the council's register: Colchester, Tendring, Braintree. Every link is checked before publication; a council can restructure its own website afterwards and break a link that worked when this was sent, which is rare but outside our control.
Coverage note. Tendring's weekly schedule of delegated planning determinations for this window was located on the council's own decision record for the period and opened; the file the council publishes returns no readable text, so its contents are not available. That schedule is the document carrying applicant names, parish grouping and the parish-by-parish "no determination" rows that allow Tendring's coverage to be demonstrated rather than asserted; without it, Tendring's entries below are drawn from the planning register and the Planning Committee papers alone.
Three Tendring applications determined at committee are listed without a link, because committee papers identify an application by reference rather than by the register's own item address, and reaching the register entry for each requires a separate lookup that was not completed for this issue. This is not because those applications are minor — one of them is the largest housing decision in this briefing. For the same reason, individual decision records adopted by Tendring officers under delegated powers this week — the five strategies, the seven housing policies and several contract awards — are described in this issue but not individually linked, except where noted.
TENDRING — FULL ENTRIES
OUTLINE PERMISSION APPROVED FOR UP TO 120 DWELLINGS AT GREAT BENTLEY (Committee determination — outline, up to 120 dwellings)
Outline permission for up to 120 dwellings on land to the north of Weeley Road, Great Bentley was approved at Tendring's Planning Committee on 3 September, with only access considered at this stage. The committee authorised outline permission subject to completion of a Section 106 agreement covering the matters summarised at paragraph 9.2 of the officer report (25/01633/OUT).
The minutes record that the site lies outside but abutting the settlement development boundary for Great Bentley, that the council's lack of a five-year housing land supply engaged the presumption in favour of sustainable development, and that the site is included as a potential housing allocation in the emerging Local Plan.
The minutes also record that a member declared himself a local ward member and predetermined on the application, withdrew from the room and took no part in the debate or the vote, and that a second member noted he had not attended the June 2026 meeting at which the application was previously before the committee.

OUTLINE PERMISSION APPROVED FOR 37 DWELLINGS AT ST OSYTH (Delegated decision — outline, 37 dwellings)
Outline permission was approved for the erection of 37 dwellings at the Wellwick Site, Colchester Road, St Osyth, with all matters reserved other than access from Colchester Road as consented under an earlier outline permission, together with associated public open space and landscaping. The application was made in 2024 and reached decision in this window (24/00560/OUT). It was decided under delegated powers; no committee report was published.

FLOODLIT PLAYZONE APPROVED AT CLIFF PARK, HARWICH (Committee determination — community sports facility)
Construction of a floodlit Football Foundation Playzone at Cliff Park, High Street, Harwich was approved at the Planning Committee on 3 September. The scheme comprises a multi-use games area with fencing, seating and associated infrastructure in Cliff Park, Dovercourt. Permission was authorised subject to no objections being received from Place Services Ecology and to the conditions at paragraph 9.2 of the officer report (25/01781/FUL).
The minutes record that the development would cause a low level of less than substantial harm to the significance of the Lower Dovercourt Conservation Area.

Both are recorded in identical terms.
On the same day and at the same address, an application for the erection of a replacement building at the rear to provide a five-bedroom house in multiple occupation was refused (260981). The applicant on all three is recorded as Nest Contractors Ltd.

Two variations were permitted, each subject to a Section 106 agreement, removing highway conditions from consented development at Witham.
At Phase 2, land at Forest Road, condition 32 was removed, which required improvements to the junction of Chipping Hill and the B1018, from a permission granted on 27 April 2018 (25/02203/VAR). THE COUNTDOWN
Colchester, Tendring and Braintree are currently due to be replaced by a single unitary authority, North East Essex Council, on 1 April 2028 — 569 days from today. That date follows from the government's March 2026 decision, which has now been withdrawn pending review, so it is the current stated date rather than a settled one.
The shadow authority election countdown is suspended for this issue. It was carried in earlier planning on the basis that elections in May 2027 would be to new shadow unitary authorities. No source now states that. Rather than count down to an election no source expects, the clock is held until the position is confirmed.

On 7 September, Colchester City Council, Tendring District Council and Braintree District Council issued a joint statement following the government's announcement of a review of local government reorganisation.
The statement records that the councils acknowledge the government's announcement that, following legal advice, it is withdrawing its current reorganisation decision for Essex and other areas, and that they await further information and formal confirmation. It restates that in March the government confirmed its preference to replace Essex's fifteen two-tier councils with five new unitary authorities, and that next steps always remained subject to the necessary legislation being passed by Parliament. It records that the councils' focus throughout has been on outcomes for residents, businesses, staff and communities whatever shape future arrangements take, and that the three councils will continue working with Essex County Council and other partners.
On the elections, the statement records that the councils understand the government intends to confirm that local elections in May 2027 will go ahead on existing council boundaries. That is the councils' stated understanding of an intention, not a decision the government has announced.

WHERE THE STATEMENT APPEARS, AND WHERE IT DOES NOT
Three days after it was issued, the joint statement appears on Tendring District Council's website. It does not appear on the Essex LGR Hub, the joint site maintained by all fifteen Greater Essex councils, whose news page still leads with the March 2026 announcement of five new councils and carries nothing later. It does not appear on Braintree's reorganisation pages, which remain current only to the March 2026 decision, and Colchester's reorganisation pages carry no reference to it.
COLCHESTER'S LGR PANEL PROGRESS REPORT
The progress and risk report published with the agenda for Colchester's LGR Transformation and Transition Panel meeting of 9 September is for noting only. It records that the panel asked in July 2026 for regular progress updates against identified actions together with emerging risks, that many tasks remain undefined and fluid and need close monitoring to avoid drift, and that the programme is well mobilised on planning and oversight while the more complex work sits in the detailed delivery phase, particularly where workstreams are interdependent and need cross-council coordination. On the current position it records that key workstreams are advancing as planned, that focus is on critical-path items, and that no significant delays or risks were identified in the delivery status of current activities.
That report was published with the agenda on or about 2 September, five days before the Secretary of State's statement, and contains no reference to the withdrawal.

Alongside it, the Habitats Regulations Assessment and the Sustainability Appraisal are consulted on under the same regulation and close on the same date. This is the pre-submission stage, at which representations are made for consideration by the Planning Inspectorate. Respond via Colchester's consultation portal.
Tendring published consultation drafts alongside five strategies adopted on 8 September — the Climate Action Strategy and Action Plan refresh, public arts, creative and cultural, tourism, and community development. Tendring's consultations page itself lists no current consultations.
Braintree lists no current active consultations.
Two of the five consultation sources across the three districts could not be read this issue. Colchester runs consultations in two places that do not overlap; the second, on the council's main website, has moved to a new domain as part of a site migration, and the listing there was opened twice and returned no entries under either open or closed consultations, which means Colchester's second strand cannot be confirmed either way. Braintree's separate engagement platform has also changed domain; it was opened on two occasions on separate dates and returned a page with no content. Neither is evidence that there is nothing to report.

HOW IT WORKS
Prior approval
Several decisions in this issue are recorded as prior approval rather than planning permission. Prior approval applies where the Town and Country Planning (General Permitted Development) (England) Order 2015 already grants permission for a class of development, but requires the developer to ask the council to consider specified matters before starting — typically siting, design, transport impact, contamination or noise, depending on the class.
Two classes appear in this issue. Under Schedule 2, Part 3, Class Q, an agricultural building may become a dwellinghouse subject to prior approval, as at Wallings Nursery Ltd in Lawford. Under Schedule 2, Part 6, Class A, agricultural development on units of five hectares or more may proceed subject to prior approval, as at Thorrington.
The council's answer takes one of three forms: prior approval is required and granted; prior approval is not required, meaning the development may proceed; or prior approval is required and refused. Because the underlying permission comes from the Order rather than from the council, the council's grounds for refusal are limited to the matters the relevant class specifies.
